Overview
This guide outlines the process for handling bankruptcy notices received from customers. Proper management of these notices is crucial to ensure compliance with legal requirements and to protect Samsara's financial interests.
Submission Process
All bankruptcy notices should be sent to bankruptcy@samsara.com.
Documentation Required:
When a customer files for bankruptcy, they must provide bankruptcy documentation as soon as possible showing that they have filed.
Actions Post-Bankruptcy Filing
- Ceasing Collections: Once a customer has provided proof of filing for bankruptcy, Samsara must stop all attempts to collect past-due amounts. This is a legal requirement to avoid violating bankruptcy laws.
- Proof of Claims (POC):
- Legal is responsible for filing Proof of Claims (POCs) if Samsara is not listed on the bankruptcy schedule or if the amount owed is greater than $1,000.
- A POC is not required if we are notified that the customer has no assets.
